Welcome to the SameWave Affiliate Program. These Affiliate Terms & Guidelines ("Terms") establish the rules and requirements for participating in our affiliate program. By joining the program and promoting SameWave, you agree to comply with these terms, our general Terms of Service, and our Privacy Policy.
1. Program Overview
The SameWave Affiliate Program allows individuals to promote SameWave to their audience and earn commissions on referred subscriptions. As an affiliate, you will receive a unique promo code to track your referrals and generate revenue through genuine promotion of our app.
2. Brand Guidelines - What You CAN Do
Approved Promotional Activities
- Share your unique promo code across social media platforms, blogs, videos, podcasts, and other content channels
- Share your genuine experience with SameWave, including personal stories about how the app has helped you and your partner
- Create original content promoting SameWave, including reviews, tutorials, testimonials, and use case demonstrations
- Highlight the 7-day bonus trial that comes with your promo code, which gives referred users access to premium features at no cost
- Use approved SameWave screenshots and assets in your promotional content (with proper attribution)
- Emphasize SameWave's core benefits: task organization, partner communication, shared responsibility management, and relationship partnership features
- Discuss subscription value and the recurring commission structure of the affiliate program
- Mention pricing and subscription options honestly and accurately
3. Prohibited Actions - What You CANNOT Do
Prohibited Promotional Practices
- Make false or misleading claims about SameWave's features, functionality, or capabilities
- Guarantee relationship outcomes such as "this app will fix your relationship," "guaranteed to solve couple conflicts," or similar promises about relationship improvements
- Create fake reviews or testimonials, including fabricated user experiences, reviews, or endorsements
- Spam or send unsolicited messages to promote your affiliate code, including unsolicited emails, text messages, or direct messages
- Use SameWave's name in domain names (e.g., samewave-promo.com) or in paid search advertisements without prior written permission
- Make income claims about the affiliate program such as "get rich promoting this app," "earn $10,000 per month," or guaranteed earnings statements
- Disparage or negatively compare SameWave to other apps or competitors
- Share your affiliate dashboard credentials with anyone else or allow others to access your account
- Use misleading urgency or scarcity tactics such as "limited time offer," "only 3 spots left," or artificial deadline pressure
- Modify, alter, or manipulate the SameWave logo, brand identity, or promotional materials
- Target minors (users under 13 years old) in any promotional content
- Make medical, therapeutic, or counseling claims about SameWave's benefits or capabilities
- Misrepresent yourself as a SameWave employee, official representative, or authorized spokesperson
- Promote the app illegally or in violation of any laws or regulations
4. Commission Structure
The SameWave Affiliate Program offers competitive and transparent commission terms:
Additional Commission Terms
- Recurring commissions: You earn 25% of each subscription payment from users referred through your promo code as long as they maintain their subscription
- Free trial exclusion: Commissions are earned only on paid subscription transactions, not on free trial periods. Once a referred user's free trial converts to a paid subscription, you begin earning commission
- Payout processing: Commissions are paid out via Stripe Connect on a monthly basis (processed around the 15th of each month for the previous month's earnings)
- Payout threshold: You must have a minimum of $1.00 in earned commissions to qualify for a payout. Commissions below this threshold will roll over to the next month
- Payment terms: All payouts are processed after fees and withholding tax requirements (where applicable) are deducted
- Currency: All commissions are paid in USD
- Attribution period: Referrals are attributed to your promo code when a new user creates an account using your unique code
5. Content Standards
As an affiliate, you are responsible for maintaining ethical and professional standards in all promotional content:
- Your content must be truthful and accurate, never misleading or deceptive
- Clearly disclose your affiliate relationship with SameWave in all promotional content
- Use clear language such as "I'm an affiliate for SameWave" or "I earn a commission when you sign up using my code"
- Respect all applicable laws and regulations regarding advertising and affiliate marketing in your jurisdiction
- Do not create content that violates anyone's intellectual property rights or privacy
- Ensure all claims about SameWave are supported by actual app features and functionality
6. Termination and Violations
Grounds for Suspension or Termination
SameWave reserves the right to suspend or immediately terminate your affiliate account for:
- Violation of any provision in these Affiliate Terms & Guidelines
- Violation of SameWave's general Terms of Service or Privacy Policy
- Engagement in fraudulent, deceptive, or illegal promotional practices
- Making false or misleading claims about SameWave
- Spamming or sending unsolicited promotional messages
- Using misleading domain names or paid advertisements without permission
- Creating fake reviews or testimonials
- Harassment, abuse, or threats toward SameWave team members or other users
- Attempting to manipulate commissions or exploit the affiliate program
- Operating from restricted jurisdictions or violating local laws
Consequences of Termination
- Immediate account suspension: Your affiliate account and promo code will be deactivated immediately upon termination
- Forfeiture of pending commissions: Upon termination for violations, pending commissions may be forfeited in their entirety
- Cessation of future earnings: You will no longer earn commissions on any subsequent referrals, even if they were tracked before termination
- Permanent ban: Serious or repeated violations may result in a permanent ban from the SameWave Affiliate Program
Voluntary Resignation
Affiliates may resign from the program at any time by notifying SameWave in writing. Upon resignation:
- Your promo code will be deactivated, but you will retain earned commissions
- Any pending commissions will be paid according to the standard payout schedule
- You may reapply to the program at any time, subject to approval
- All previously referred users and their subscriptions will no longer generate commission for you
7. General Terms
Program Modifications
SameWave may modify these Affiliate Terms & Guidelines at any time. We will notify you of material changes by posting updated terms and updating the "Last updated" date. Continued participation in the program after changes constitutes your acceptance of the new terms.
Tax Responsibility
As an affiliate, you are an independent contractor responsible for:
- Paying all applicable income taxes on affiliate commission earnings
- Providing accurate tax information for payout processing (including Tax ID or Social Security Number in the United States)
- Complying with all local, state, and federal tax laws
- Filing appropriate tax returns for your affiliate income
SameWave is not responsible for tax withholding or reporting beyond what is legally required in your jurisdiction.
Relationship to SameWave
By participating in the affiliate program, you understand that:
- You are an independent contractor, not an employee of SameWave
- You have no authority to bind SameWave to any agreements or commitments
- You may not make representations on behalf of SameWave without prior written authorization
- You are solely responsible for your own promotional content and marketing materials
Limitation of Liability
To the maximum extent permitted by law:
- SameWave is not liable for any lost commissions, interrupted service, or technical issues affecting the affiliate program
- SameWave is not responsible for disputes between you and your referred users
- All earnings are provided "as is" without warranties of any kind
8. Additional Requirements
To maintain your status as an active SameWave affiliate:
- You must comply with these terms and our general Terms of Service
- You must maintain a valid email address and contact information in your affiliate account
- You must respond to compliance inquiries from SameWave within 10 business days
- You agree that SameWave may audit your promotional content for compliance with these guidelines
- You must cease all promotion of SameWave immediately upon account termination

10. Governing Law
These Affiliate Terms & Guidelines are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these terms or your participation in the affiliate program shall be resolved through binding arbitration.
11. Entire Agreement
These Affiliate Terms & Guidelines, together with SameWave's Terms of Service and Privacy Policy, constitute the entire agreement between you and SameWave regarding your participation in the affiliate program and supersede all prior agreements and understandings.
